L’Inquisition, souvent associée aux images de torture, bûchers et persécutions, incarne dans l’imaginaire collectif un Moyen Âge obscurantiste. Pourtant, la réalité historique de cette institution est bien plus nuancée. Conçue à l’origine comme un réseau de tribunaux ecclésiastiques, l’Inquisition visait à éradiquer les hérésies menaçant l’unité de l’Église catholique. En s’inspirant du droit romain, elle traversa plusieurs phases d’évolution, influencées par les contextes sociaux, politiques et religieux propres à chaque époque.

Officiellement instituée au XIIIe siècle par le pape Grégoire IX, l’Inquisition médiévale naquit en réponse aux hérésies comme le catharisme en Occitanie, ainsi qu’aux doctrines gnostiques et arianistes. Soutenue par des figures politiques telles que l’empereur Frédéric II, l’Inquisition put intensifier sa répression avec des lois strictes contre l’hérésie, visant à préserver un ordre social fragilisé par des conflits internes comme les croisades albigeoises. Contrairement aux idées reçues, son influence ne se limita pas au Moyen Âge : du XVe au XVIIe siècle, elle connut une extension marquée par la lutte contre la Réforme protestante, notamment en Espagne où les conversos et morisques furent ciblés pour des soupçons de pratiques religieuses clandestines.

Malgré sa réputation de brutalité, l’Inquisition fit preuve d’une relative modération par rapport aux tribunaux civils de l’époque. Ses procédures innovantes, basées sur des enquêtes minutieuses et une quête systématique de preuves, apportèrent des évolutions notables au droit pénal, notamment dans l’usage de la preuve écrite. Les historiens notent que le nombre de condamnations à mort par l’Inquisition reste inférieur à celui d’autres tribunaux, comme lors de la Terreur révolutionnaire en France. Aujourd’hui, la perception de l’Inquisition oscille entre celle d’un outil répressif fanatique et celle d’une institution cherchant à réguler la violence, reflétant les tensions religieuses et politiques de son époque.
