L’arme fait-elle le meurtrier ? La question, jamais vraiment résolue, a toujours passionné les juristes. Mais si l’on en croit aujourd’hui certains représentants de l’État, avoir dans sa poche un Laguiole, un Nontron ou l’œuvre d’un coutelier d’art fait désormais de son détenteur un criminel en puissance. Ni plus ni moins. Comment en est-on arrivé là ? 

La loi française interdit clairement le port de tout couteau, assimilé à une arme blanche de catégorie D, au même titre que les haches, les machettes, les poignards de combat, les matraques télescopiques, les bombes lacrymogènes ou les poings américains. Mais la jurisprudence des tribunaux était jusqu’ici un peu plus souple et considérait avec une certaine bienveillance ces couteaux qui font partie des traditions régionales et paysannes. En clair, tout dépendait du contexte, de leur utilisation et de la tolérance des forces de l’ordre.
